Woman who fatally shot man at Walmart parking lot won’t be charged

Charges won’t be brought against a woman who fatally shot a U.S. Army veteran at a Walmart store in North Lauderdale.

Per WPLG Local 10, the Broward County State Attorney’s Office identified the woman as Melissa Payne in a closeout memo.

“If at the time Melissa Payne used deadly force: she was not doing anything unlawful; was in a place she had a right to be; and ‘she reasonably believe[d] that using or threatening to use such force [was] necessary to prevent imminent death or great bodily harm,’ then she is immune from arrest and prosecution,” the memo said.

Payne is said to have shot Bart Diguglielmo on June 30. The incident occurred at the parking lot of a Walmart in North Lauderdale after they got into a disagreement when they tried to park in the same parking space.

Memo disclosed that the incident was captured on multiple videos. Prosecutors said Payne and Diguglielmo exited their vehicles after a “brief stalemate.”

The memo also stated that Diguglielmo left his car in the travel lane, then entered Walmart while holding a shopping cart. Diguglielmo then came back to his vehicle after about 90 seconds. Two witnesses said that Diguglielmo subsequently told Payne, “I’m gonna f*** your shit up,” per the memo.

Prosecutors said Diguglielmo then moved his car before parking about two aisles from Payne’s car. Witnesses said Diguglielmo also said it appeared Diguglielmo was angry while he was taking a look at Payne, adding that he was shaking. 

Payne then came out of her car after Diguglielmo approached her. She was said to be in possession of her phone and a gun at the time. 

She told Diguglielmo, per the memo, “If you keep coming up to me, I’m going to f***ing shoot you!” 

The memo also stated that witnesses told the pair that their back-and-forth wasn’t “worth it!”

Per WPLG Local 10, Prosecutors also said that Payne cautioned Diguglielmo, “Don’t come over here!” “Don’t come near my car!” and “Don’t try that!”

Diguglielmo is said to have subsequently approached Payne after he initially withdrew. Payne then opened fire on Diguglielmo.
